Effective globally for all WILD Success entities, including WILD Success, YWS Coaching Pty Ltd, WILD Success LLC, their affiliates, trainers, contractors, and providers (“the Provider”).
DEFINITIONS
“Breathwork” refers to any guided or self-directed practice involving intentional or conscious control of breathing patterns designed to influence physical, emotional, or mental states. This includes all online live sessions, replays, recordings, or related educational materials provided by the Provider. By enrolling in, joining, or participating in any Breathwork session, program, or class (“the Session”), whether live or recorded, I acknowledge, understand, and agree to the following:
1. VOLUNTARY PARTICIPATION
I am participating voluntarily and of my own free will. I have read, understood, and agree to all warnings, risks, and conditions contained in this Disclaimer and Waiver.
2. ASSUMPTION OF RISK
I understand that Breathwork may result in physical and emotional responses, including but not limited to changes in breathing rate, heart rate, dizziness, tingling, emotional release, or other sensations. I accept that these are normal responses to such practices. I understand that Breathwork can create intense physical, emotional, or psychological experiences and that I participate entirely at my own risk.
3. CONTRAINDICATIONS
I acknowledge that Breathwork is contraindicated for individuals with any of the following conditions and that I must not participate if any apply to me:
i. Cardiovascular disease, including angina, prior heart attack, or stroke;
ii. Detached retina or glaucoma;
iii. Diagnosed brain or abdominal aneurysm;
iv. Epilepsy or seizures;
v. Thyroid conditions;
vi. High blood pressure;
vii. Pregnancy;
viii. Respiratory issues including asthma;
ix. Diabetes;
x. Bipolar disorder, schizophrenia, or any other psychiatric condition;
xi. Any other serious medical or psychological condition that may be aggravated by intensive breathing or emotional release.
4. MEDICAL DISCLAIMER
I understand that Breathwork practices offered by the Provider are not a substitute for medical or psychological treatment, diagnosis, or advice. The Provider is not a medical practitioner, and no information, guidance, or facilitation provided should be considered medical advice or therapy.
I confirm that I have consulted, or will consult, my licensed healthcare provider before engaging in Breathwork to determine whether it is appropriate for me. If I am taking any medication or have any medical or psychological condition, I acknowledge that I must not participate without prior approval from a qualified medical professional.
5. PERSONAL RESPONSIBILITY
I acknowledge that I am fully responsible for:
Assessing my own physical, emotional, and mental readiness;
Ensuring that my participation complies with the laws and health regulations of my jurisdiction;
Ceasing participation immediately if I feel discomfort, distress, or instability; and
Conducting my own due diligence before engaging in Breathwork.
6. WAIVER AND RELEASE OF LIABILITY
To the fullest extent permitted by applicable law, I hereby waive, release, and discharge the Provider and its directors, officers, employees, contractors, trainers, representatives, affiliates, and agents from any and all claims, demands, liabilities, losses, damages, or causes of action (whether known or unknown) arising out of or connected to my participation in Breathwork sessions, including any live or recorded broadcasts or replays. I expressly agree that this waiver extends to all claims of negligence, whether active or passive, except for gross negligence or willful misconduct where not waivable under law.
7. INDEMNIFICATION
I agree to indemnify, defend, and hold harmless the Provider and its associated entities and representatives from any claims, damages, costs, or expenses (including reasonable legal fees) arising from my participation or any breach of this Disclaimer.
8. GLOBAL APPLICATION AND GOVERNING LAW
This Disclaimer and Waiver is intended to have effect worldwide, to the maximum extent permitted by the laws of any jurisdiction in which I reside or participate. If any provision is held unenforceable, the remainder shall remain in full effect.
Unless otherwise required by local law, disputes shall be governed by the laws of the jurisdiction in which the Provider is registered or operates.
9. ELECTRONIC CONSENT
By joining, registering for, or accessing any Breathwork class, program, live broadcast, or replay, I confirm that I have read, understood, and agreed to this Disclaimer and Waiver electronically. My participation constitutes a legally binding agreement equivalent to a signed written document. It is with this understanding that I voluntarily accept and agree to this Disclaimer and Waiver in its entirety.
